Saks 5th Suing Customer

Saks Fifth Avenue Sues Customer Over Mis-Priced Jewelry Sale

Long story short, customer buys a jewelry set for $28,000 (which is the price she was told by the sales associate) but the real price was $76,000. So now Saks is suing her cuz she won't give it back.

What would you do?

Honestly, I think its Saks fault. I work retail and if a sign says the shirt is $9.99 we have to sell it to the customer for that, even if we later find out the sign should have said $12.99. It's our responsibility to sell the item to the customer at the price advertised or told. Granted, thats not a $50,000 difference, but still.

I think saks should eat it, too.
Its not as if the customer switched a ticket or anything. (well, not that I know.. I wasn't there or anything)

I agree if thats the price and she asked then I think its on them, happens to me at nordies rack something is marked something and then rings up different or SA changed price? should I bring back my clothing they need to train their SA better I guess

I would say the claim could more likely be with the SA for negligently mis-entering the price

Yeah they have no case here. TBH though, if i was the buyer, i'd return the thing. Seems the ethical thing to do to me

^ Yes, it is ethical only because the SA is probably in shit for an honest mistake I would return it for that reason, but certainly not after this crap.

I might have considered returning it until finding out that Saks was suing me. Then I definitely wouldn't.

If you'd have returned it, it would never have come to a suit anyway.

I could just never in good conscience wear/own something of that kind of value i essentially had not paid for.

I think its the sales Assistant fault...

this. If you walk into a store for a product and its the stores responsibility to tell you how much money they want for said product, how can they penalize the customer who clearly had the intention of BUYING the product and not STEAL it? I wouldnt return it either that kind of money is pennies to them.

Definately the SA's fault. The only case Sak might have would be against the SA.
