Help! Should I file a dispute case on ebay over this issue?

Hi, so I recently ran into some issues with a seller on ebay. I bought a pair of jeans from her, however the package lost while on its way. I asked the seller to file a claim with the postal services, and a few weeks later they located the package and sent it back to the seller. I asked her to resend it back to me at no additional charges, however she offered to give me full refund for the jeans and refused to resend it back to me. My question is: can I file a dispute case on ebay against her for refusing to resend the jeans back to me with no additional charges? After all I would still like to have the jeans.

Any help/advise would be appreciated

You can file a dispute but it won't make her send them to you. If you file item not received then you will just get a refund. Can you tell the seller you would rather have the jeans than a refund again? If she says no then just take the refund and move on. Probably wants to try to get more $$ or something for the item.

Yeah I'll just ask the seller to send me the jeans again, and if she refuses then I guess I'll have no choice but to take the refund. I really like the jeans and have been looking for it for a long time, and was overjoyed when I found it on ebay but I don't want the seller to charge more money on it after I already paid so much on it

could leave negative feedback and file a seller nonperformance against them but it really doesn't do much - and it won't get you the item. Best to just take the refund and move on.

This is interesting to me as a small seller on ebay...I want to find out what other sellers would do in this situation? For example if I sell something for $10 + $6 shipping the shipping charge barely covers the actual $5.10 shipping cost plus ebay takes a fee out of it as a seller should we spend another $5.10 of our own $ to reship the item? Then we would be practically giving the item away. I am torn on this as a small seller - I sell just to earn spending $ as I have no job at the moment. I want to have good customer service & I understand it was not either parties fault because the PO lost the item but what would most sellers do?

If it is post office error you shouldn't be covering anything out of your pocket. Take it in to the post office and explain the situation. If it is truly there error then you can get them to reship it for "free" since you already paid postage. If it is your error that's a different story.

Ok I was wondering if it should be covered by the PO. I would pay to reship if I made the mistake by mislabeling etc of course.

they definitely will, if the counter person refuses to do so just speak with their manager or call the 800 number.
