New without tag item arrived altered -- what to do?

Hi everyone, I won an auction for a pair of J Brand Lovestory jeans a few days ago that were listed as "new without tag." I got them at a good price and they arrived quickly. They smelled of detergent but some people wash clothes as soon as they get them so that is fine. However, the jeans I received have been altered. The inseam has been shortened and the hems changed. This is more significant with this style of jean as it comes with a very distinctive hem, like the ones pictured here - http://www.jbrandjeans.com/2722-peti...ry/d/2163?cs=1

I have gone back to look at the pictures in the auction again and it does show the altered hem. There is no mention of it in the description. I realize I should have examined the pictures better before buying the jeans. You can see the original auction here - http://www.ebay.co.uk/itm/3208280123...84.m1497.l2649

I do like the jeans overall and would like to keep them. I'm thinking of taking them to a tailor to see if the hems can be made to look like the original Lovestory style again. I don't know if it would be appropriate to ask the seller for a small refund, perhaps a refund of the shipping charge (around 4.00/$6.00) to go towards the alterations. Either way, I would like to at least contact the seller to politely let her know about the situation as she might like to be a little more thorough in her next listings. I'd really appreciate your opinions on this

Edit: Sorry, I don't know why it says default on the title!

There is a good chance that the seller didn't know how the hems are supposed to look and that is why they didn't mention anything I would've been pissed at myself for not catching it on the pics provided but some people not looking closely once they see that magical NWT letters .

Anyway, try to email them and state the problem politely and see what they do

Hmmm, to be honest, there are two photos which show the hems pretty clearly. They have also listed the inseam measurement at 26", which would have immediately made me question whether they had been hemmed. I'm not sure you can really expect the seller to make a partial refund. Emailing them and letting them know wouldn't hurt though...

Thanks for the replies everyone

Yes, I didn't catch the 26" inseam until I looked at the auction today. RobinF is right, seeing "new" in the listing made me a little less careful. The jeans I received aren't a 26" inseam though, as I can try them on with 3-4 inch heels and they still reach the floor. I'm 5'2" for reference.

I think I will just send her a polite message just letting her know about the hems and not ask for anything, since I am happy enough to keep the jeans.

I agree.. and from the pics the jeans look worn or washed at least once to me.. if you send her a link of what the jeans should look like, she may say she didn't know and that the pics showed clearly that there was no original hem.. which is true.. sorry

Thanks for the input. I've sent her a message letting her know I like the jeans but making her aware of the discrepancies.

Also, it appears the seller also sold another pair of Lovestory jeans, with the exact same alteration to the hems. The pictures are different so she didn't recycle the same pics for both listings. I don't think she could have overlooked the hems if she is claiming both pairs came from net-a-porter and were brand new (without tag) http://www.ebay.co.uk/itm/J-Brand-Lo...item4ab2d71f39

Those don't look NWOT at all to me! I have gotten NWT or NWOT that have been hemmed too short and were store returns or the person couldn't return.
Those look washed IMO. If you wanted to return, i think you would win the case... but since you want to keep them I would just forget it and move on I think they are pretty and a tailor can work with the hems if you have enough fabric to work with.

Thanks for the reply, laurenbwg I think they are washed as well, and smelled very strongly of laundry soap when I first opened the package. The seller disagrees though

This is the message I sent her --

I have received the jeans, they were packed well and I like them, thank you. However, I noticed that these jeans have been altered at the hems, which changes the actual style of the jeans. If you look at your listing for the jeans and click the NET-A-PORTER link, to compare them to the jeans I have received, you can see a significant difference. The J Brand Lovestory Jean is famous for its trouser hem, which has sadly been removed and altered from these jeans.

Also, this pair has been washed and are missing the inside white style tag. I am quite disappointed as the jeans are not brand new without tag as stated in the listing.

And this is the reply I received --

Thank you for your email.

Please note that I can garantee you that these jeans have never been used or washed. I would not sell anything under a description that is not true as you can see by my other listings.

Awhile back I had purchased 6 pairs of jeans from NET-A-PORTER. 4 x with small flares ie. lovestory and heart breaker and 2 x cigarette style.

The ones with the flares did not suit me which is why I just left them in the back of my cupboard hoping that one day I would change my mind as they had a beautiful colour and as all women know...we do change our minds

The length of the jeans is clearly stated on the item specifics. (Please have a look at the order and look under leg length.) I ordered a shorter leg length for me (as they were and sometimes still are available in different lengths on NET-A-PORTER.)I can honestly say that all of my jeans that came from that delivery had the same hemline.

As for the inside labels all I am not sure what you mean as I have photographed everything that was on the inside?

I find it rather unlikely that she received that many pairs of altered/faulty jeans from NET-A-PORTER and didn't notice, or didn't send them back for a replacement pair or refund. She's also claiming they've never been washed. She is standing by all of that though, and does not seem to want to offer any compensation towards fixing the hems, though I asked for none.

I'm a little bummed that she won't at least admit to the discrepancies but think I will just keep them though, as at 5 shipping to me, and about 6 registered shipping back to her, I'll be out half what I paid for the jeans already. They are nice jeans at least, apart from the hem issue, and I appreciate the seller's quick response time.

What is the wash name (should say on the tag)? I have never heard of something arriving altered from Net-a-porter. J Brands generally come with a 34"+ inseam unless it's a skinny (910) or another cropped pair. That's bull.

The jeans are missing the little white tag so I have no idea. I am pretty sure they are Lovestory jeans though as they match up on the rise, the skinny thighs and flared leg, and the distinct button.

The jeans are authentic at least but you're right, I think it's all bull. The inseam on the pair I was sent is something like 30 inches. Luckily this still works for me. She is claiming they are Petite but those would still come with a 32 inch inseam. Also, when I asked her if she had a transaction number or receipt from NAP so we could inquire about the discrepancy, she said she used her ex's account and could no longer access it.

I do like the jeans enough for the price paid, but may have to pay more to fix the hems, and hate that she is feeding me a load of crap.

Yeah, that's frustrating. Very convenient that it's under her ex's account
