Buyer opened paypal SNAD about FIT

Sold jeans NOT on Ebay (but had been on Ebay before buyer contacted me about them) to buyer. Size and measurements provided. She emailed me this morning and wrote : "Good afternoon,
I have received the jeans & they are beautiful. Unfortunately, they don't fit well at all. Will you accept them back for a refund? Thanks"

I wrote back "sorry, no returns for fit issues blah blah blah"

and she opened a SIGNIFICANTLY NOT AS DESCRIBED with paypal and this note attached to claim "Received item & very unhappy with fit. Fit is almost irregular. Would like a full refund. Thanks"

I know Ebay caves to buyers for just about anything, but how about a non-Ebay Paypal claim? Do I have a fight? Anyone who has experience with this, thanks for responding!

Off ebay transactions do not qualify for SNAD claims so she is not going to win. (Unless they have changed that recently)

It's always best to just call Paypal and talk to them though. They are going to be more helpful then a forum.

Spoke with Paypal and am reassured, as the rep also said "it sounds like buyer's remorse." Next worry: Even if I win paypal claim, can she file a charge back with credit card? That happened to me years back, and then, even though I had won with Paypal, the credit card company favored buyer, gave her the money back (which then Paypal took from my acct) and I never even got the dress back (DVF vintage!) So I was out BOTH. But I am hoping this couldn't happen over "jeans don't fit me" crap-claim. ?

Paypal decided in my favor (THAT was quick). Now just waiting for some chargeback shitstorm to begin...anyone know if that could happen in a case like this?

Yes. And they would be required to ship them back to you in order to win their chargeback claim with their CC company.

Last year I purchased an item from an ebay seller but in an off ebay transaction. (I had missed the auction by seconds and there were no bids so I asked to purchase off ebay for a little less). The jeans arrived with a giant repaired hole in the butt that was not mentioned in the listing. I couldn't file a paypal claim since it was not on ebay so I had to file with my CC. They wanted to see proof that I returned them to Seller before they would refund it.

It depends on the CC i think. I've done chargebacks and never had to show my CC anything in the way of proof. Nonetheless, paypal should side with you anyway and the fight the chargeback for themselves since you followed the seller protection policy.

So you never had to show your CC that you shipped them and you were refunded? (Trying to prepare myself for all possible scenarios).

They did change this last year in November I believe. Buyers can file SNAD and win outside of ebay.

If it is a merchandise chargeback seller protection will not help you. Seller can fight it but most of the time buyer always wins those ... and then the seller has to accept a return regardless.

This is an actual except from PP's website:

When you are not covered:

"You've received a claim or a chargeback, and the shipped item is found to be significantly different than it was described."

The word "significant" is up to interpretation, so it is beneficial for the OP to have the ad or listing that doesn't leave them liable for fit issues because everyone's body is different.

Don't think paypal will care in most cases. If the buyer chooses to appeal that case or file a chargeback the buyer will win. Regardless of what the listing says. Best thing to do is rather than waste time trying to make the buyer keep the item, suck it up and take a return. The time you wasted trying to make them keep the item is time you could be making money by doing work that would actually benefit your business. Not to mention the headache that goes along with all the drama. Started taking returns about 2 years ago and it has actually helped my business. Get a lot of repeat customers from people who returned items and then turn around and buy something else.
