| | | Advice needed on misrepresented jeans-Won case..thoughts on feedback? Here is the auction William Rast Savoy Ultra Lowrise Trouser Jeans 26 - eBay (item 110722378426 end time Aug-05-11 19:22:49 PDT)
Notice at the bottom where I specifically asked what the inseam was and she responds 35"-which is the ONLY reason I bid so high on these.
After looking at some of her feedback I started to get a little sketched out...so I emailed her to find out shipping details (since they weren't listed in ebay tools). No response to both of my emails.
The jeans show up yesterday and they are a FREAKING 32.5" inseam-which is too short for me. Not to mention that I would have NEVER even bought them...especially for taht much!
So I email her yesterday and basically say I would like to return (even though she has a "no return" policy b/c the item was misrepresented.
Haven't heard anything back yet, but if things go bad (which I think they may) will ebay side with me?
Any advice is appreciated...
Thanks! |

| | | That is a BIG difference! If you file a SNAD claim, eBay will almost definitely side with you. I would give her another day to respond, though, and just see what she has to say. If you can't get a response, file a claim.

| | Yup, file a claim.
Just an FYI, the chances of you finding a pair of Evening wash with the kind of inseam are slim to none unless there were a freak pair made. I have bought/sold/owned dozens and dozens of pairs of Evening wash ul Savoy's and they are usually always 32.5-33. Maybe 33.5 at max. That particular pair was just made with a pretty short inseam.
Gardenia ultra low rise Savoy's are going to be your best bet at getting a longer inseam. I think mine were 34 or 34.5. But still, a 35 isn't likely to happen, especially on a smaller size like that.
I feel your pain. I'd love to just once have a pair of Savoy flares that I could wear with heels. I need a 34" for ballet flats. |

| | | Hey Amber...I remembered that you told me that evenings are usually short...but I was SO hoping that these were a freak pair and I was gonna get lucky...yeah...not so much.

| | | ARGHHHHHHHHHHHHHHHH! Sometime's I hate people!!
So I emailed the seller and asked for a refund...OF COURSE she doesn't respond. So I open a case.
this is the email I get from her Seller's message:
"Hi again, I have not heard back from you. I have picture evidence proving that the inseam is indeed what I told you it was, and also, on the website where I purchased these jeans, the correct inseam I provided you with is also listed there. If you really don;t like them, I suggest listing them again to ge tyour money back, as I do not accept returns, and I did not misrepresent this item. Thank you, Sydney"
So she never sent me an email in the first place, and as you can see from the listing...there's no "photographic evidence" to support her bs claim.
The thing I don't understand is...WHY would I lie about the inseam length and want a FULL refund? I mean she can get the jeans back and resell. If the jeans were the actual 35" inseam-I would have left positive feedback and been done with it.
So just to cya, I took pictures too, but will it come down to that? I am going to probably have to escalate the case and have ebay make a decision. |

| | just escalate.
IMO the photos will never be asked for by eBay.
ETA: Her listing says she bought them at Saks. I couldn't find an old webpage with them but the Emoda page has them listed as a 33" inseam and highly doubt Saks stated 35". http://www.emoda.com/item.asp?prodid=123333

| | | So I won the case thru ebay and got my $ back.
Any thoughts on leaving negative feeback? or is that just rubbing it in? and on the flip side...can she then neg me? she seems llike she would be the type to leave something nasty on my feedback..even though she was at fault
Thanks!

| | | Sellers are no longer allowed to leave anything other then Positive feedback. If she were to leave a 'negative' comment under a positive feedback then you can definitely have it removed. So it's totally up to you. I would probably neg her since she didn't even consider that she may have made a mistake. |

| | | Thanks everyone! I just didn't want to be "that buyer"...
I gotta say, this month has been terrible with sellers on ebay (had to open 3 cases) which is strange to me...since I have never had a problem in the 10 years I've been on. Guess I have been extremely lucky...
Thanks again for all the input and GREAT advice! | | Thread Tools | | | | Display Modes | Linear Mode |
